EU Data Act
From September 12, 2025, the new provisions of the EU Data Act (Regulation (EU) 2023/2854) will come into force, aiming to promote a more competitive and innovative data economy in Europe and give users greater control over their data.
Devices for data collection (e.g. Wi-Fi-enabled devices) must be designed to provide usage or environmental data upon user request. Users have the right to access, use, and share their data. Sellers must provide the following information:
- Details on storage options and whether the device generates data in real-time.
- Instructions on how to retrieve and delete data.

What are my obligations?
You must indicate for relevant product categories whether a product falls under the provisions of the EU Data Act. If so, you must provide information (via a link) about which data is collected, processed, and stored by the device.
You can request this data from the manufacturers of the affected products, who typically provide a URL to a page containing the relevant information. This link must then be assigned to the respective products in the Seller Portal.
How do I submit the required information for selling on Kaufland marketplaces?
You can provide the information manually via the Seller Portal, through a CSV/XML file, or via the Marketplace Seller API.
1. Manual entry in the Seller Portal
- Navigate to your offers und and open the product data of the affected products (read more about product data here).
- Under “Attributes,” you will find the fields “Concerns Data Act” and “Smart Device Info URL.”
- First, specify under “Concerns Data Act” with “Yes/No” whether the product is affected.
- If “Yes”: Add the manufacturer’s URL link in the field “Smart Device Info URL.”
- This process must be repeated for each individual item.

2. Submission via CSV/XML file
- Indicate whether the product is affected by the EU Data Act by populating the attribute “is_smart_device” (ID: 3872) with ‘Yes’ or ‘No.’
- If the product falls under the provisions of the EU Data Act, add the manufacturer’s URL in the field for the attribute “smart_device_manufacturer_information_url” (ID: 3875).
Note
Both attributes can be filled simultaneously!
3. Submission via API
