Kaufland.es – EPR Guidelines for Spain
The EPR (Extended Producer Responsibility) guidelines regulate manufacturers’ responsibility to collect, recycle and dispose of products in certain categories.

Who has to register for the EPR guidelines in Spain?
The obligation applies to everyone deemed a “first distributor” (often collectively defined as “manufacturers”). In Spain, you are considered a “manufacturer” (“productor de producto”) and are required to register if you are placing products from the relevant categories on the Spanish market for the first time.
The following actors must register for the EPR directive in Spain:
- Manufacturers who bring products to the Spanish market under their own brand or name.
- Importers and intra-community purchasers who import products into Spain.
- Distance sellers who sell products to end customers in Spain, regardless of their company headquarters.
Please note:
Sellers not based in Spain must appoint an Authorised Representative (Representante Autorizado) based in Spain to handle the registration and EPR obligations on their behalf.
The overarching legal framework for EPR obligations in Spain is the Waste Law Ley 7/2022 de residuos y suelos contaminados. More information can be found at the Spanish Ministry of the Environment , MITECO.

What do I have to do to fulfil the extended producer responsibility requirements in Spain?
Step 1: Apply for a Spanish tax identification number (NIF).
Requirement: You need a Spanish tax ID (NIF – Número de Identificación Fiscal) to register for the EPR. You cannot register for the EPR without an NIF.
Sellers not based in Spain usually apply for the NIF through their authorised representative or a service partner based in Spain.
Please note:
The NIF application process takes additional time (about 2-4 weeks). This should be completed before the actual EPR registration begins.
Step 2: Registration with the manufacturer’s register and with a PRO
Your product range will determine exactly which registrations you need. Please check whether an EPR is required for each of your product categories.
Once you complete the registration process, you will receive your EPR number(s).

Non-Spanish sellers must appoint an authorised representative in Spain for their own registration.

Important for your time planning: Allow sufficient lead time for the entire process. The processing by the authorities takes some time:
- NIF application: approximately 2 to 4 weeks
- EPR registration: approximately 2 to 3 weeks (per waste stream, after receipt of the NIF)
Step 3: Enter the EPR number(s) in the Seller Portal
Once you have received your EPR number(s), enter them in the Seller Portal to activate your offers in the relevant categories for Kaufland.es:
- In the Seller Portal , go to Shop Settings and select the EPR Compliance tab.
- Use the selection in the top right corner to ensure that the sales country Kaufland.es is selected.
- Click on “Add another EPR number”.
- In the window that opens, first select the product category (e.g. packaging, electrical and electronic equipment, batteries). The system will then show you the expected format of the registration number for the selected category (e.g. ENV/YEAR/XXXXXXXXX for packaging).
- Enter your EPR number in the field provided.
- Click on “Submit for review”. Your number will then be validated and listed in the overview.
Repeat the process for each applicable category in which you offer products.
Step 4: Quantity report to PRO
Sellers must regularly report the quantities placed on the market (number of units, sales volume or weight) for each category to their Producer Responsibility Organization (PRO/SCRAP). These quantities form the basis for calculating recycling fees. For packaging, the annual declaration is typically due by 28th February of the following year. Step 5: Payment of the recycling fee (eco-contribution)
In addition to reporting quantities, seller pay eco-contributions to their PRO. The amount depends on the product category and the reported quantity, material, and weight. The seller is responsible for correct reporting and timely payment.
Step 6: Include the EPR number on invoices
Your EPR number for each category must be shown on customer invoices and related business documents.
Take-back obligations (WEEE 1:1 Take-back)
If you offer electrical and electronic equipment in Spain, you are obliged to offer free take-back of a similar old device when a new device is sold ( 1:1 take-back). You must provide marketplace customers with information about return options – enter this in your GTCs in the Seller Portal under Shop Settings > Legal Texts > GTCs.
