Information about the Electrical and Electronic Equipment Act and the associated take-back obligations for sellers

If you sell electrical goods, we urge you to read the following information carefully and to take it into account in the future.

Since 1st January 2022, stricter legal take-back obligations apply to the 1:1 take-back of certain electrical goods. We want to provide a successful shopping experience for our mutual customers, and this includes providing simple and transparent customer service processes. Therefore, on Kaufland.de, the take-back of WEEE is mandatory for products affected by the Electrical and Electronic Equipment Act, regardless of the size of your storage and sales areas. Sellers who sell electrical goods from the affected appliance categories on Kaufland.de are obligated to offer customers a free-of-charge WEEE take-back or return option via Kaufland.de.

This applies to the following categories:

– Category 1: Heat exchangers such as refrigerators, but also humidifiers and camping coolers.
– Category 2: Screens and monitors with a surface area of more than 100 cm².
– Category 3: Lamps
– Category 4: Large appliances where at least one of the external dimensions is more than 50 centimeters.
– Category 5: Small appliances where none of the external dimensions exceeds 50 centimeters.
– Category 6: Small information and telecommunication technology equipment where none of the external dimensions exceeds 50 cm.

Category 1, 2 or 4: If the customer purchases a device from these categories from you, you must offer the free collection of a corresponding old device from the customer.

Category 3, 5 or 6: If a customer purchases a device from these categories from you, a suitable return facility must be provided within a reasonable distance from the customer.

Please find the details in the legal regulation, the original wording of which can be found under this link.

How does Kaufland Global Marketplace support the implementation?

1. Identification of the affected products
Our system automatically recognises when a customer places a product affected by the Electrical and Electronic Equipment Act from the above categories in the shopping basket.

2. Option for the customer for WEEE take-back
When placing an order, the customer has the option to select the free-of-charge return of WEEE. It is pointed out that only old devices that correspond to the new device can be returned.

3. Creation of a ticket for the desired WEEE take-back
If the customer selects the return of WEEE and completes the purchase, a ticket is automatically created in the Kaufland.de ticket system. The ticket reason here is: “WEEE take-back”. As a seller, you can access and edit this ticket as usual in the Seller Portal and via the API.

Once the ticket has been created, you as a seller are responsible for communicating with the customer and ensuring that the WEEE is properly taken back.

What do you have to do as a seller?

11. Communication with the customer
Using the ticket automatically created in the Kaufland.de ticket system, you as a seller must obtain all the necessary information for collection from the customer. This can be, for example, information about the dimensions or weight that is relevant for the type of collection.

You don’t have the possibility to offer WEEE take-back? We can help!

In this case, please contact our customer service via the ticket system and write in the ticket that you cannot offer WEEE take-back. The collection and disposal will then be coordinated by us and the costs incurred will be passed on to you. The costs are charged to your Kaufland.de credit and appear as a separate item on your monthly commission statements. The costs for the WEEE take-back carried out by Kaufland.de including disposal and processing of the procedure are as follows:

– Take-back of equipment via parcel service provider: 23 euro net, plus the legally owed VAT
– Take-back of equipment via freight forwarding service provider: 79 euro net, plus the legally owed VAT

2. Deciding the method of WEEE take-back
As a seller, you are responsible for deciding what is appropriate for the collection and return of the WEEE:

– Collection by a freight forwarder
– Returns label/collection by a parcel service provider
– Notification of a return location in reasonable proximity

We recommend that you contact your shipping service provider and initiate everything necessary for the implementation of the WEEE take-back, as well as any disposal and documentation obligations if you sell the above-mentioned products.

If you have any further questions, please do not hesitate to contact us by e-mail or telephone.
